Court Judgments of the Week, both decisions of Holgate J:

• Girling V East Suffolk Council & EDF & NNB [2020] EWHC 2579 a challenge to the grant of permission for major development in the AONB, replacement facilities related to Sizewell B, required as a precursor to a new Sizewell C nuclear power station raising issues about alternative sites and if the EIA was up to date. 
• London Historic Parks v Secretary of State HCLG [2020] EWHC 2580   a case relating to the proposed Holocaust Memorial in Victoria Tower Gardens; whether the requirements for independence and objectivity in Art 9a of the EU Directive are properly transposed and if so if the handling arrangements to deal with called-in applications comply with reg 64 (2) if the EIA Regs 2017.

Appeals of the Week:  (1) Successful appeal for 105 C3 units scheme (2) an unsuccessful attempt to secure 505 dwellings on Green Belt land in Edinburgh.
