Court Judgments of the Week:
- City & Country Bramshill Ltd v Secretary of State for HC&LG & Hart DC et al[2021]EWCA Civ 320, a Court of Appeal decision dismissing an appeal from the developer against a decision of Waksman J who partly allowed & partly dismissed challenges to an inspector’s decision to refuse planning permission in relation to development at Bramshill Park, Hampshire raising questions about the interpretation of policy related to heritage & isolated homes in the countryside.
- Anchor Hanover Group v Arcadis Consulting Ltd [2021] EWHC 543 (TCC) A decision of O’Farrell J on 9 March dismissing an application by the Environment Agency to summarily dismiss a claim for damages based on a duty of care at common owed by the EA in commenting on hydraulic modelling & in so doing arguably going beyond its statutory duty.
Decisions of the Week:
- Camp Hill, Birmingham, a decision of 8th March allowing a recovered appeal against Birmingham City Council’s refusal to grant permission on a site in B2/B8 use for a residentially led mixed use scheme of 7 blocks within the City Centre Growth Area in the development plan, raising issues about the delivery of Camp Hill Chord.
- Odeon Cinema, Shaftesbury Ave a decision of 10 March an inspector’s decision dismissing appeals by Capital Start Ltd against the refusals of the London Borough of Camden to grant listed building consent & planning permission for the refurbishment, and two storey roof extension and basement levels in the Grade II LB.
