Decisions of the Week:

  • Decision of the Supreme Court in DB Symmetry Ltd & anor V Swindon Borough Council [2022} UKSC 33 dated 14th December 2022 dismissing an appeal against the decision of the Court of Appeal which declined to confirm that the Court of Appeal in Hall & Co Ltd V Shoreham-by-Sea UDC [1964] 1WLR 240 erred in law in that case that held that a LPA could not lawfully require a landowner by means of a planning condition to dedicate land as a public highway and thereby avoid the payment of compensation.
  • Decision of the High Court in R (oao Philip Addison) V London Borough of Southwark & Anors  [2022] EWHC 3211 (Admin) dated 6th December 2022 dismissing  a challenge to the grant of planning permission for the redevelopment of Champion Hill Stadium & neighbouring astroturf pitch, raising issues about mistake of fact, failure to apply planning policy and failure to discharge the Public Sector Equality Duty.
  • Decision of the Minister of State for Housing dated 14 December 2022 allowing an appeal made by Redrow Homes (Yorkshire) against the failure of City of York Council to determine an application for circa 970 dwellings, associated demolition, infrastructure, primary school, community facilities and A1 store on land allocated in the emerging Local Plan ST8, in the context of Huntingdon NP & the saved policies of the otherwise revoked Yorkshire & Humber RSS 2008. Land in GB and VSC demonstrated.
  • Decisions of an inspector dated 28 November 2022 allowing one appeal by Berkeley Homes (Southern) Ltd against the decision of Guildford BC relating to a hybrid application on Lower Road Effingham for 4 self-build & 110 units and dismissing another appeal against the refusal of RMA for the erection of 99 dwellings on Howard of Effingham School. Land in GB, issues of viability raised.
